LEGAL ACTIONS

Contact

After demands have been issued and attempts to make contact have been exhausted, often a field call will enable us to make contact with an individual who doesn’t want to answer the phone or respond to mail or email.

Our Field Agents are fully licensed and we only deal with those who work within the parameters of the ACCC guidelines. Often the fact that we have made contact will get them to interact with us but also ensures that we know that they individual is still at an address. Again, the cost to us is the cost to you. More often than not this is under $100.00

Tracing

It is not unusual that an individual may have moved on from the address they gave you. Even if you are unsure of where they are now, we have relationships with several skip tracing agents who will make attempts to locate any individual to enable us to continue to pursue a debt, and the cost to us is the cost to you. Often around $150.00 to $200.00 if successful.

Court Action

Most trading debts incurred fall within the jurisdiction of the simplified Minor Civil Disputes area of courts and tribunals throughout Australia. The Collection Company can handle the issue of all proceedings within those jurisdictions and have enforcement experience in all state courts throughout Australia so if the court makes an order to pay, we know what to do to enforce that payment no matter where they may be and can handle most of the debt recovery process for you without the need for your involvement

And Beyond

When the nature of the debt does require the involvement of a solicitor.

A Winding Up application for example or matters exceeding a certain debt level. If so we have access to legal advice from around Australia  and if we do need to engage a law firm, we only use lawyers who focus on debt recovery issues and you are made well aware of the cost before any charges are incurred. If the need arises you can of course also use your own or we can liaise with them as may be required.

Local Government Rates and Charges Recovery

The Collection Company Pty Ltd is able to provide specialist debt recovery services to local governments across Australia, assisting councils to recover overdue rates and water charges efficiently, professionally and in accordance with legislative requirements. Our approach recognises that every account represents a member of the community, balancing firm recovery action with fairness, respect and a commitment to achieving practical outcomes wherever possible.

Our structured recovery process includes account assessment, debtor engagement, payment arrangement management, field services, skip tracing, legal escalation and enforcement where required. We work collaboratively with councils to maximise recoveries while protecting community relationships and ensuring all recovery activity is undertaken in accordance with Council policies, approved procedures and applicable legislation.

Where voluntary payment cannot be achieved, The Collection Company has the experience and legal capability to assist councils through the statutory sale of land process for overdue rates and charges. Working alongside our specialist legal partners, we support every stage of the process, from initial statutory notices through to auction, conveyancing and finalisation, ensuring legislative compliance throughout.

We recognise that local government debt recovery requires a respectful and considered approach when engaging with vulnerable members of the community, including Aboriginal and Torres Strait Islander peoples, the elderly, people experiencing financial hardship, disability or illness, and those facing other personal challenges.

Our team is committed to treating every individual with dignity, empathy and professionalism, working collaboratively with councils to identify appropriate support pathways and sustainable payment solutions wherever possible, while ensuring recovery activities remain fair, compliant and consistent with Council's community responsibilities.
